Shifting of DVAC chief challenged
The DMK has moved the Madras High Court to quash the appointment of Mohan Pyare as Vigilance Commissioner. Represented by its organisation secretary, R S Bharathi contended it is a tenure post appointed by the Governor, on the advice of the cabinet of the State government under Article 163 (1) of the Constitution of India.

But not withstanding this, the State represented by its Chief Secretary earlier appointed Jeyakodi as the State Vigilance Commissioner by divesting the Chief Secretary of the post. Now, by the passing the present impugned order Mohan Pyare has been appointed in the place of Jeyakodi with the same illegality.
Noting that it is an independent post, which cannot be filled by an officer from the administrative side, by way of transfer and posting at the whims and fancies of the government like a transferable post, said the fact that the present appointee like the earlier appointee is junior in rank to several officers will make him unable to investigate any accusation of high level corruption against either the Chief Secretary or other secretaries’ senior to him.
Also pointing out that the appointment is nothing but an attempt to make DMK’s earlier petition challenging Jeyakodi’s appointment as infructuous.
