    Ship firm informs about wrong submission

    Even as the Madras High Court has allowed BW Maple to sail out of Chennai, the counsel appearing for Dawn Kancheepuram has submitted that inadvertently an erroneous submission that a draft bank guarantee of amount equivalent to the one furnished by BW Maple has been made while such an offer is yet to materialise.

    The first bench comprising Chief Justice Indira Banerjee and Justice M Sundar through an order on October 10 had refused to restrain the sailing of the BW Maple after holding that, “The Council appearing on behalf of MT Dawn Kancheepuram submits that the said vessel has also submitted a draft bank guarantee of equivalent amount, which is awaiting approval of the Directorate General of Shipping (DGS).” 

    However, a few days later Dawn Kancheepuram’s counsel and assistant solicitor general on conceding that the bank guarantee equivalent to the Rs.203 crore submitted by BW Maple is yet to be made said, “A draft of the terms and conditions of the amount of bank guarantee is under negotiation and that the DGS is insisting on equivalent amount.” 

    The bench on incorporating the submission in its order directed the registry to issue a corrected certified copy to the respective parties upon return of the original. The bench also directed all the parties to return the original certified copies issued to them. On January 28, BW Maple, which was leaving Ennore port after emptying LPG collided with Dawn Kanchipuram loaded with petroleum oil lubricant resulting in an oil spill.
