    TRB allowed to process applications, restrained from making appointments

    The HC has directed the State to abstain from making any appointments to the Post Graduate Assistants/Physical Education Directors, Grade I as notified by the Teachers Recruitment Board (TRB) while allowing it to process the applications.

    Tamil Nadu Association for the Rights of All Types of Differently Abled and Caregivers (TARATDAC) had moved a PIL petition before the summer vacation bench to direct the authorities to provide 4 percent reservation for persons with disabilities as per section 34 of the Rights of Persons with Disabilities Act 2016. The bench which ordered notice to the State had posted the matter for further hearing to June 2. 

    However, after the re-opening of the court the same was posted before the first bench comprising Chief Justice Indira Banerjee and Justice M. Sundar. The Additional Advocate General K.Venkataramani, placed before the bench that a Government Order dated May 30. 2017, wherein a corrigendum has been issued and the three per cent reservation has been enhanced to four per cent in conformity with Section 34 of the of the Rights of Persons with Disabilities Act, 2016. But with the petitioner specifically stating that the Government does not have any power to specify the percentage of disabilities, the bench said. 

    “It is the specific case of the petitioner that the appropriate Government does not have any power to specify the percentage of the disabilities. In other words, the issue is whether the Government has statutory power to specify the percentage of the disabilities.” 

    Based on this submission, the bench held that “In the light of the above submission, we deem it appropriate to the pass a limited order to the effect that the Government shall proceed with processing of the applications received pursuant to the impugned employment notice, but shall not make any appointments.” 

    Also recording the aspect that the written examination stage of the recruitment is on July 2 and that the additional advocate general requires a fortnight to get instructions on the issue raised, posted the case for further hearing to June 16.

    Penalise cops for not acting on banners for MK birthday: Petition 
    The Madras High Court has granted three weeks to the special government pleader to file a counter on a plea seeking action against police officials for failing to act on the illegal digital banners erected by DMK office bearers as part of the Birthday celebration of DMK Leader M Karunanidhi.
    Justice M. Duraiswamy before whom the petition filed by social activist Traffic Ramaswamy came up on Wednesday adjourned the matter by three weeks. The petitioner while referring to an HC order dated March 16, 2016 which directed not to display any hoardings and banners till a decision is taken on the issue, submitted that on June 03, 2017 huge number of unauthorised digital banners were erected on the sides of the road by DMK office bearers and also office bearers of the Congress party from Guindy to the airport. He further submitted that his complaints to Teynampet, Abiramapuram and Triplicane and Guindy police stations failed to evoke any response and instead he was threatened by the Triplicane and Abiramapuram police inspectors of dire consequences if he persisted with his complaint.
    Notice to govt in VC case
    The HC has ordered notice returnable by two weeks to the State government on a plea to probe into the allegations against the V-C of Tamil Nadu University of Veterinary and Animal Sciences (TANUVAS).  Justice M M Sundresh passed the direction on the plea seeking to constitute a high-level panel to probe into the allegations against S Thilagar, V-C, TANUVAS. The petitioner said that Thilagar has been facing various charges including large scale violations in the recent recruitments to the post of Assistant Professors. He further submitted that the Board of Management of the University on April 11 resolved to constitute a committee comprising members in the grade of senior professors and officers to probe into the allegations. Alleging that the members subordinate to the V-C cannot hold independent probe, the petitioner sought for a probe by a committee of individual members in the grade equal to or above that of a VC.
