Habeas Corpus plea to produce MLAs and plea to convert Veda Nilayam into memorial dismissed

Even as the HC dismissed the habeas corpus plea seeking to produce two AIADMK MLA’s of Krishnarayapuram and Kunnam reportedly held captive in Koovathur resort, it also came down heavily on the advocates who had moved the plea saying they failed to adhere to the etiquette prescribed under the Bar Council of India (BCI) rules. 

A division bench comprising Justice M Jaichandran and Justice T Mathivanan, while rejecting the suggestion to appoint a commissioner or an amicus to make an independent study as to whether the MLAs were held captive, said “We have carefully considered the submissions made on both sides and having taken into consideration the relevant facts, we find that since the question of maintainability is hanging over the petition, we do not find any merits.”

Regarding a petition by S Parthiban of Saidapet seeking direction to state to convert late Jayalalithaa’s Poes Garden residence as a memorial, a  division bench comprising Justice Huluvadi G Ramesh and Justice R Mahadevan dismissed the plea after holding that “It appears that seeking identical relief a writ petition was filed before the Madurai Bench of this court and by order dated January 12, 2017, the said WP was dismissed as not maintainable. In view of the above, nothing remains to be reconsidered in the present WP.”
