400 petitions over FIR issue trashed
A day after the Madras High Court ruled that a plea under section 482 of CrPC seeking a direction to the police registering an FIR is not maintainable, over 400 such petitions were disposed of in a single stroke.
Chennai
Justice PN Prakash disposed the petitions based on his order issued on September 27 that those seeking relief under section 482 of CrPC should approach the High Court only after approaching the police station, the SP and Jurisdictional Magistrate concerned.
Based on this, Justice Prakash disposed the plea with the liberty to the petitioners to follow the procedure laid down in the order and file a fresh petition if necessary.
