Vishal, who is the proprietor of Vishal Film Factory, is accused of not depositing the tax deducted from the employees’ salary (TDS) within the stipulated time with the Income Tax department for five years.

The department has filed five cases against the actor before the Additional Chief Metropolitan Magistrate II, Economic Offences Court, Egmore. After he failed to appear despite repeated summons, Magistrate S Malarmathi issued the warrant on Friday. The counsel who appeared for Vishal on Friday denied the receipt of such summons by accused and filed a petition for absence of his client. But M Sheela, the public prosecutor for Income Tax department, objected to this and wondered how the counsel could file a memo of appearance and file a petition to condone the absence of the accused when the counsel himself has stated that summons was not received.

The public prosecutor also submitted the acknowledgement for the receipt of summons by Vishal, and stated that this was the second such summon sent to the actor. He has not appeared despite receiving such summons, she said, and sought for issuing warrant.

The court concurred with the submissions of the public prosecutor for the I-T department and issued a non-bailable warrant.
