Tribunal awards Rs 22.6 lakh to kin of mason killed in mishap

Five years after a mason sustained fatal injuries in a road accident near Karanodai Bazaar, the Motor Accidents Claims Tribunal has directed the Reliance General Insurance Company Ltd to pay Rs 22.6 lakh as compensation to the kin of the deceased.

The petition, filed under Section 166 and 140 of Motor Vehicles Act and Rule 3 of MACT, claimed a compensation of Rs 74 lakh for the death of P Mani (44) in an accident on October 31, 2014. According to the petition filed by M Angammal, her husband Mani was returning home after work at Karanodai Bazaar when while crossing GNT Road, a car which came from Red Hills side to Janappan Chatram in a rash and negligent manner hit him.

Mani sustained grievous injuries and died on the spot. “The driver of the car and the insurance firm, being the insurer of the vehicle, are jointly and severally statutorily vicariously liable to pay the compensation,” read the petition.

Countering this, the insurance firm denied the allegations and submitted that the amounts claimed under the various head are exorbitant and excessive.

Recording the submissions, Judge V Sutha held that driver of the car was responsible for the accident and awarded Rs 22.6 lakh with a 7.5 per cent interest as compensation to the kin of Mani. The judge also directed the firm to deposit the amount within two months to the tribunal’s bank account.
