How will Nalini, Murugan talking to kin abroad affect MDMA probe: HC

The bid by Murugan and Nalini, life convicts in Rajiv Gandhi assassination case, to speak to their kin abroad through WhatsApp video calls continued unabated as the Madras High Court on Wednesday sought the Centre to explain as to whether the CBI-led Multidisciplinary Monitoring Agency’s (MDMA) probe into alleged larger conspiracy behind the assassination of Rajiv Gandhi is functional.

A division bench comprising justice N Kirubakaran and Justice VM Velumani sought the explanation after Additional Solicitor General Karthikeyan claimed that allowing Nalini and Murugan to speak to relatives abroad would affect the ongoing probe by MDMA into the foreign links behind the assassination of the former PM.

To this, the bench, wondering as to whether the couple is going to be conversing about the US Presidential elections, sought to know as to how Nalini and Murugan talking to their relatives could affect MDMA probe.

The bench also noted that the couple is going to be speaking in Tamil under the eyes of the officials and if they detect anything offensive, the call is bound to be disconnected.Advocate M Radhakrishnan, appearing for Nalini and Murugan, submitted that based on Jain commission recommendations, the MDMA was formed 20 years ago and after 2015 no extension of time was offered and hence the agency is bound to be non-functional.

To this, State Public prosecutor A Natarajan pointed out that in a plea moved by another convict AG Perarivalan, the Supreme Court in 2018 had sought the MDMA to file a report, which meant that the agency had not concluded its probe.

The Supreme Court in January 2020 had expressed displeasure over the latest status report filed by the MDMA on its probe and had wanted to know about the progress made in the ongoing investigation in the past two years.The court will hear the case again on August 19.
