Centre accepts 50 per cent OBC reservation in medical admissions under AIQ

The Union of India and Directorate General of Health services has informed the Madras HC that the Ministry of Health and Family Welfare in an affidavit filed at the SC proposed to apply State specific reservation for OBCs on all available All India Quota (AIQ) seats in UG, PG medical and Dental with a condition that the overall reservation will not exceed 50% of total available seats.

The submission was made in a counter filed in response to the plea moved by the State government and political parties including the DMK and AIADMK seeking to implement 50% reservation to OBCs as per the Tamil Nadu Backward Classes, Scheduled Castes and Scheduled Tribes (Reservation of Seats in Educational Institutions and of appointments or posts in the Services under the State) Act, 1993.

However, the counter stated that existing reservation for the unreserved (UR), ST and SC will not be disturbed by proportionately increasing the number of seats with the cooperation of all participating States and MCI. On implementation of State Specific Reservation Policy for SC, ST and OBC, TN will have to contribute AIQ seats category-wise including those reserved for physically handicapped candidates by maintaining roster at college/State level. The counter also sought for a direction to the petitioners to get themselves impleaded before the top court in a writ petition pending before the SC wherein the same issue of providing reservation to OBC candidates is under consideration and the case is posted (tentatively) on July 8.
