Court dismisses bail plea by two TNPSC scam accused

Principal Sessions and District Court, Chennai dismissed bail applications of two Tamil Nadu Public Service Commission (TNPSC) recruitment scam accused after hearing the petitions over the phone.

One of them, M Muthukumar, was arrested on February 26 based on a case registered by CBCID Organised Crime Unit (OCU) and CBCID Metro Wing each for various offences punishable under Indian Penal Code. Counsel for Muthukumar submitted that the petitioner has been remaining in custody for more than 60 days and prayed for granting of bail, contending that he is entitled to the benefit under Section 167(ii) of Criminal Procedure Code.

Objecting the bail application, the City Public Prosecutor (CPP) contended that Muthukumar and his accomplices cheated several persons and tampered with the OMR Sheets and committed large-scale scam in the TNPSC Examinations relating to Group-IV and Group-IIA and other examinations.

Citing High Court order, CPP said that section 167(ii) of CrPC is not applicable and limitation has been extended by the Supreme Court.

Recording the submissions, Principal Judge Selvakumar dismissed the bail application.

Similarly, M Suyamburaj, a Village Administrative Officer who was arrested on February 2 for offences punishable under various sections of Indian Penal Code moved a bail application before the principal judge. Suyamburaj, a native of Tirunelveli has allegedly paid Rs 7 lakh to a middleman, Jayakumar, for clearing the Group IV examination. He also sought the bail under section 166(ii) of CrPC. The government pleader raised objections citing the orders of the High Court and the Supreme Court. Considering the nature of the case, Judge dismissed the bail applications. He is also being investigated by the CBCID OCU.
