Amid growing demand by various political parties for early action by Governor Banwarilal Purohit on the State Cabinet recommending the release of all the seven life convicts in the former Prime Minister Rajiv Gandhi assassination case, the Tamil Nadu Government today said the Raj Bhavan will take a final decision based on the report to be submitted in the Apex Court by the MMDA.

Replying during the demand for grants for his department in the State Assembly, Law Minister C Ve Shanmugam said the State Cabinet had adopted a resolution on September 9, 2018 recommending their release to the Governor under Article 161 of the Constitution.

Responding to DMK MLA Thayagam Kavi's 's query on the issue, the Minister said since no decision was taken by the Raj Bhavan, a reminder was sent to the Governor's Secretariat, which in its reply to the government, said the Governor would take a final decision (on the Cabinet resolution) based on the report to be submitted in the Supreme Court by the Multi Disciplinary Monitoring Agency (MDMA), comprising several investigating Agencies, including the CBI, which was still probing the case.

It may be recalled that when the issue was raised by the Opposition DMK during the budget session in February, Chief Minister Edappadi K Palaniswami hoped that the Governor would take a good decision on the release of the convicts.

Winding up the debate on the budget, Deputy leader of the Opposition Duraimurugan cited the Supreme Court's directive asking the State government to seek response from the Raj Bhavan on the State Cabinet resolution recommending release of the convicts, and wanted the government to insist on it.

To this, Mr Shanmugham said having forwarded the resolution, the State Government could not interfere in the powers of Governor.

''The government has done all it could within the rules...It is for the Governor to take a decision'', he added, he said and added that late leader J Jayalalithaa's wish was that the convicts should be released.
