Pay Rs 1L for custodial torture: SHRC

The State Human Rights Commission (SHRC) has recommended the government to pay compensation of Rs 1 lakh to a petitioner who was reportedly tortured for three days by police personnel before producing him in front of the judicial magistrate in Salem district. The petitioner claimed that his wives were also dragged to the police station and kept back for a day.

According to the petition, Silarkhan was picked up by a few policemen from Attur station for inquiry in a case pertaining to Gopi, a ward councillor of Narasingapuram panchayat, on July 23, 2013. As soon as he reached the station, the then inspector, Sampathkumar, beat him up severely, the petition alleged. He was then taken to the Theevattipatti station where the then inspector, Kannan, also beat him up. Claiming that he was implicated in the criminal case filed against Gopi, he further said that after three days of torture and illegal detention, he was produced before the court and remanded in jail.


Silarkhan also claimed that no action was taken despite complaints to higher officials in this regard. Countering this, Sampathkumar and Kannan denied the claim and submitted that there was no human rights violation.


SHRC, however, held that both had violated Silarkhan’s rights and that he was entitled to a compensation of Rs 1 lakh. The government shall recover the said sum from the duo, it further held.
