A division bench comprising Justices M Sathyanarayanan and R Hemalatha, before whom the plea moved by K Gopinath, the president of the Hindu Munnetra Kazhagam came up, said the Supreme Court and the high court have offered various guidelines regarding protests and based on it, the Tamil Nadu police have been taking suitable decisions. Hence, there was no need to pass any order on this plea, the bench said.

The plea had sought for a direction to the police to restrain all Muslim organisations from holding demonstrations, rallies or any other form of protest on December 6, or even on a future date, to mark the anniversary of Babri Masjid demolition.

Noting that condemning the apex court verdict would attract contempt of court proceedings, the petitioner claimed that such demonstrations and rallies are unwarranted as the verdict is by the highest court of the land and that too by a Constitution Bench whose judgment is binding on all and that no appeal is possible.
