After a division bench comprising Justice M Sathyanarayanan and Justice N Seshsayee, commenced their sitting for the day, Advocate Richard Wilson, appearing for the DMK, made a mention seeking the bench to take its affidavit on record in the pending pleas moved by activist ‘Traffic’ K R Ramaswamy against illegal banners.
DMK organising secretary R S Bharathi had submitted in the affidavit that owing to the catena of orders of this high court, relating to curbing of illegal digital banners and the fact that it causes safety concern for pedestrians as well as to vehicular traffic, DMK president M K Stalin even while functioning as the working president had written a letter to his cadre on January 29, 2017.
Through the said letter, he cautioned the DMK party cadre not to resort to erection of such illegal digital banners, flex boards and cut-outs in any of the party functions or other functions. Likewise, the party headquarters had also issued instructions to the party functionaries. Even on September 13, 2019, Stalin had issued a similar diktat, the affidavit said.
Also, citing the writ petition that it had filed following the death of a boy in Coimbatore reportedly owing to an illegal arch installed by the AIADMK and the court order thereafter, the affidavit submitted that the DMK party not only abides by the orders of this court but has also been actively seeking to curb the menace of illegal banners, hoardings placed by other parties by approaching this court.
“The death of Subhasri at Pallikaranai recently in a road accident due to the fall of an illegal digital banner erected at the centre median by the AIADMK party shocks our conscience.
“Such a young life has been lost unnecessarily and the persons responsible must certainly be brought to book,” the plea added.
