HC directs revival of Private Colleges Appellate Tribunal
The Madras High Court has directed the Education Department to issue appropriate notification reviving the Private Colleges Appellate Tribunal constituted under Section 38 of The Tamil Nadu Private Colleges (Regulation) Act, 1976, to adjudicate issues arising between the staff and college managements.

Closing a batch of plea relating to Thamilavel Uma Maheswaranar Karanthai Arts College, Thanjavur, Justice S M Subramaniam, said, “When the statute contemplates Tribunal for effective adjudication of the issues by the aggrieved persons and the Government has also decided to issue a notification for the revival of the Tribunal, which was wound up, then this Court is of the opinion that the decision of the Government is, undoubtedly, in the interest of larger public and the same must be allowed to be completed as stated.”
Also, noting that this Court is of the opinion that such an opportunity is to be provided to all the aggrieved persons, who all are entitled to prefer an appeal before the Tribunal, the judge directed the Secretary to Government, Higher Education Department, to issue appropriate notification implementing Section 38 of the Act, by constituting Tribunals for deciding the statutory appeals to be filed under Section 21 of the Act within 12 weeks.
The judge further held that the said College Management is at liberty to re-present the returned appeal papers to the jurisdictional tribunal, within four weeks from the date of issuance of the notification.
The pleas related to regularising the service of two professors who were dismissed in 2012, provide back wages and also quash the consequential orders passed.
