    ‘Probe charge on fuel outlet on river bank’

    The HC has directed the authorities to ensure that the place as sought by Shell India Markets Private Ltd (SIMPL) to open and operate a new road-side petroleum retail outlet is not situated on a riverbank as alleged at Thottipalayam village in Tirupur North Taluk.

    Justice S Vaidyanathan on recording the submission made by the Tirupur Tahsildar that only after inspection and ensuring that the place is not located in a prohibited area, a suitable decision will be taken, directed the authority to conduct an enquiry so as to find the viability of the place in question and take a decision within a month from the date of commencement of enquiry. While making it clear that the petitioner and SIMPT official shall appear in person and furnish all documents in support of their respective plea, the judge said, “Even though, several points have been raised by the petitioner, this court is not inclined to go in depth, as it is for the authority concerned to take a decision with regard to giving NOC, Explosive License and other necessary approvals, permissions, consents to SIMPL.” The petitioner V Gopinath had sought to forbear the DRO, Tiruppur, from issuing NOC, Explosive License and other approvals to open and operate a Petroleum Outlet at Thottipalayam Village, as the place selected by SIMPL is in a prohibited area and more so, on the riverbed.
