Chennai
The first bench comprising Chief Justice Tahilramani and Justice P Duraiswamy before whom the plea came directed the district Collector as well as the Municipal Commissioner to file their replies by June 19, when the plea would be taken up for further hearing.
VS Babu of Maduravoyal had submitted that he had purchased 0.40 cent land in 2006 and the Poonamallee Tahsildar had issued the patta for the same in 2011. Thereafter, when he attempted to level the land, the local AIADMK Taluk Secretary A Sankar arrived with a few men and threatened him from filling the pit in the land.
Following this, a police complaint was lodged and the police on investigation claimed that the land is meant to be a cremation ground for Veeraraghava village, and no action had come forth owing to political pressure.
The petitioner further noted that as per the revenue records, the land part of the Survey No.3 is meant to be a graveyard. The locals on encroaching that land had claimed that Survey No.2 as a crematorium and placed a board staking claim for it.Â
Notwithstanding this, the Commissioner had also allowed the construction of a platform for holding the crematorium, the petitioner added and sought a direction to remove the platform and handoverhis land to him.
