On noting that it was unfortunate that the SP had revealed the number of videos he had received as well as the number of accused even in the preliminary stage of investigation, the bench held, “We find that this has provoked the public in sharing other videos on social media. The irresponsible conduct of the police is highly condemnable. It is appropriate to issue a direction to the State government to take disciplinary action as against the said police officer.”
Further, the bench quoted psychiatrist D Shalini from Chennai who stated on social media that she had been receiving dangerous feedback from male patients about the consequences of sharing the video.
“These videos revealing the victim’s identity violate their basic right of privacy, dignity guaranteed under Article 21 of the Constitution. Therefore, the circulation of such violent videos, especially in connection with the Pollachi case, has to be prohibited.” “The Central government and the Secretary, Internet Service Providers Association of India, who has been suo motu impleaded in the case, are directed to prohibit circulation of scandalous videos in connection with the Pollachi sexual abuse scandal,” the bench said, while directing the registry to place the matter before the Chief Justice to get orders regarding listing the matter to deal with the interim prayers sought.
