    Life convict gets 2 weeks parole for conjugal visit High

    Citing a judgement, which says, “Conjugal visit leads to strong family bonds and keep the family functional rather than the family becoming dysfunctional due to prolonged isolation and lack of sexual contact,” the Madras High Court has granted two weeks parole to a life convict lodged in Cuddalore prison based on a plea moved by his wife seeking leave for her husband for exercise of conjugal rights.

    A division bench comprising Justice CT Selvam and Justice S Ramathilagam on admitting a habeas corpus petition moved by P Muthumari, said, “It is patently made clear that the life convict Perumal @ Pethaperumal should be granted leave for two weeks from December 15 to 29, without fail for the purpose of conjugal visit.”


    “The jail authorities, during the two weeks period of leave, shall provide adequate and proper escort to the life convict, viz Perumal @ Pethaperumal, in order to ensure his safety and security and the expenses for escort shall be borne out by the State Government,” the bench added.


    During the hearing, the additional public prosecutor R Prathap Kumar had argued against grant of leave on the basis that the petitioner’s husband is an under-trial prisoner in two cases on the files of the sessions court in Tirunelveli and Pudukottai and the jail authorities are precluded from granting parole to the detenu.


    However, the bench on quoting a judgement of the Madurai bench that, “Psychologists and psychiatrists believe that the frustration, tension, the ill feelings and the heart burnings can be reduced and a human being can be better constructed if they are allowed conjugal relationship even rarely,” said “Being in agreement with the observations, we consider it appropriate to grant leave to the petitioner’s husband for the purpose stated bythe petitioner.”
