Orders reserved on GO transferring idol theft cases to CBI
The Madras High Court on Thursday reserved its orders on a plea challenging the GO transferring temple theft cases from Idol Wing police to the Central Bureau of Investigation.
Chennai
A division bench comprising Justice R Mahadevan and Justice P D Audikesavlu hearing the case through video conferencing with the later sitting at the Madurai bench, reserved orders without mentioning a date. Earlier, advocate general Vijay Narayan justified the State’s move in transferring the case to the CBI holding that the cases posed interstate and international ramifications and CBI alone had the necessary expertise and infrastructure as the process also involved extradition of certain people involved.Â
However, the bench raised several queries as to how the State went ahead passing a GO despite the High Court directing the transfer of all cases to the sessions court at Kumbakonam. While the bench pointed out that move by the State transferring the case would set a wrong precedent and tantamount to contempt of court, the advocate general noted that the creation of Idol wing was not based on any court order and the government is bestowed with the right to transfer the case to CBI.
