Justice PN Prakash, before whom a plea was moved by G Senguttavan, brother of the deceased Tamil Selvan, directed the SP to appear before him on August 28. The plea alleged that the Parvakottai Police Station Inspector Subramanian is trying to save the prime accused in the case by stating that he is abroad. As per the case, on December 25, 2005, Tamilselvan after bathing his cattle was proceeding towards the main road, when four persons including Poyyamozhi, Elangovan, then President of Ullikkottai Panchayat and another person Ullikkottai Selvam attacked him. The gang severed his arm escaped in an autorickshaw with the arm, Tamilsevan subsequently died at a hospital on the same day.
Based on the investigation, an FIR was registered and subsequently the final report was filed before the Mannargudi Judicial Magistrate-II on August 11, 2006. Thereafter it was referred to the appropriate sessions court.
Now, the petitioner in his plea has submitted that after several litigations in the trial court and High Court, the trial court spilt the case and hurriedly trying to conclude the trial, without the presence of the prime accused.
He further contended that the though the police seized the passport of Poyyamozhi, the officers, particularly Paravakottai police inspector Subramanian, is trying to safeguard the accused by stating that he is abroad, which was not true.
Further, the petitioner on noting that accused in the case are trying to threaten him as well as the witnesses, submitted that the lower court without insisting the police to bring the prime accused, is trying to conclude the trial by splitting the case. The petitioner, besides seeking to punish the inspector for protecting the accused by not producing him in court, also sought the high court to direct the lower court seeking records on the progress of the trial without the presence of the prime accused.
