    The Madurai Bench of the Madras High Court on Thursday granted interim injunction on a single bench order restraining Jamal Mohideen from holding the position of Secretary and Correspondent of MSS Wakf Board College in Madurai.

    The order comes in the wake of a petition filed by Sardar Basha, a General Body member of the College. The petitioner claimed that Mohideen was charged with allegations of misappropriation of college funds.

    Moreover, he was in favour of the college’s former Principal, against whom sexual assault charge was framed. Mohideen had also allegedly acted against the management.

    During his tenure, Mohideen made an appointment of lecturer after collecting Rs 35 lakh from the applicant and Rs 15 lakh for appointing an office staff member in the college. Such acts brought disrepute to the management of the college.

    Since the allegations were proved true, the management dismissed him from the post. The court had also dismissed a petition challenging the interim injunction order.

    Meanwhile, Principal Secretary to Backward Classes and Minorities Welfare issued a government order recommending Mohideen as a member of the General Body, despite the fact that he was ineligible to hold the post.

    Based on the recommendation, Mohideen was reinstated into the college as Secretary and Correspondent. Further, the management announced that he would hold his position in the interim until the formation of the General Body on October 10, 2017. However, he continued to hold the position.

    Hence, the government order issued by the Principal Secretary should be dismissed and an interim injunction must be ordered against Mohideen, the petitioner prayed.

    On hearing the petition, Justice MS Ramesh ordered the interim injunction and posted the case to further hearing for the next four weeks.
