TTV Dhinakaran party symbol kept in abeyance

In a major twist to the ‘Two Leaves’ symbol case, the Supreme Court on Wednesday directed the Delhi High Court to set up a division bench to decide on the main dispute between the two AIADMK factions over their claims on ‘Two Leaves’ by April end.

A division bench comprising Chief Justice Dipak Misra and Justice AM Khanwilkar also ordered that the ‘Pressure Cooker’ symbol granted to TTV Dhinakaran’s Amma Makkal Munnetra Kazhgam will be ‘kept in abeyance’ till the main dispute is settled.

According to Dhinakaran’s lawyers, it is a great victory for their side since the ruling party which has already won ‘Two Leaves’ symbol could not drag the case for years while enjoying the advantage of using the party symbol. They now face the risk of losing ‘Two Leaves’ too since it could be frozen for ever.

Fisheries Minister D Jayakumar said, “The speeding up of the case would be in their favour since they could permanently get the ‘Two Leaves’ symbol since most of the general council members and the party are with them at the moment.”

AIADMK leaders feel Dhinakaran would not be able to draw the general council members and senior functionaries of the AIADMK to his side as long as the party remained in power. A judgment before April 30 would only uphold the EC order and end Dhinakaran’s claim for the ‘Two Leaves’ for ever, they feel.

Dhinakaran’s lawyer Raja Senthoor Pandian said, “The order is actually a victory for us since the final order in ‘Two Leaves’ case has been advanced. The SC has only ‘kept in abeyance’ the order of the Delhi HC to grant ‘Pressure Cooker’ symbol.”

Pandian also said the order would not come in the way of AMMK getting a symbol in case any elections were held before April 30, since the court had suggested that Dhinakaran could approach the court for a symbol whenever an election is notified.
