Justice T Raja, before whom the petitions filed by LS Vasanthimalar and B Subramaniyam, Additional Secretary and Joint Secretary respectively of Legislative Assembly came up for hearing on Tuesday, adjourned it to Wednesday.
Senior Counsel P Wilson appearing for the petitioners submitted that Advocate general Vijay Narayan flouted the undertaking given by him on March 2 that no appointment would be made when the plea for maintenance of status quo was made. He said despite AG’s assurance, the rules were amended giving retrospective effect on March 3 and Srinivasan was appointed as secretary. “This court had never experienced such a breach of undertaking by the highest law officer of the state,” Wilson added.
However, the AG on clarifying that he never offered any undertaking, now that they have challenged the appointment, a counter affidavit will be filed.
