Plea on a row over Rs 10 coin dismissed
The Madras High Court has dismissed a writ petition seeking for a direction to act on the Tiruttani Inspector of Police for not registering a complaint against a tea shop owner for failing to receive Rs 10 coin.
Chennai
Justice T Raja, who dismissed the petition, said, “The petitioner has given two complaints (September 10 and 25, 2017). In none of these complaints, he has made any mention about his illegal detention in Tiruttani police station. Moreover, nowhere has he mentioned the intervention of two of his counsel for his release from illegal detention.
This shows that the petitioner has come to this court with an afterthought.” “Therefore, this court is unable to entertain this writ petition. It is well settled legal position that one should come to the court with clean hands. In the present case, it is clear from the documents filed in support of the petition that the petitioner has not come to this court with clean hands. Therefore, the Writ Petition fails and the same is dismissed.”
The petitioner had submitted that he along with his wife and uncle went to a tea shop and after purchasing coffee at the rate of Rs 12/- (Rs 12 x 2 persons), gave two Rs 10 notes and one Rs 10 coin. But, the tea shop owner refused to accept the Rs 10 coin stating that it is invalid.
In the altercation that ensued over this, the petitioner claimed the police instead of receiving his complaint detained him for about four hours and he was released only after the intervention of two advocates.
