Justice R Mahadevan before whom the petition filed by the students and also by SVMC and PIMS came up on granting the interim stay said, “Considering the facts and circumstances of the case and having regard to the rival submissions in the interest of Justice there shall be an order of interim stay till February 6”.

The judge also directed the petitioner to file their affidavits and MCI, Union Ministry of Health and Family Welfare and Puducherry Health and Family Services Department to file their counters by then.

The students had submitted that MCI of India had passed the impugned order on December 12, 2017 confirming its earlier order on July 24, 2017, directing SVMC and PIMS to discharge the students of Sri Venkateshara Medical College of Puducherry who were admitted to PG Medical courses for the academic year 2017-2018 without issuing any notice and without providing the opportunity of personal hearing to them.

It was also contended that the colleges admitted those candidates, who presented themselves on the last date for admission and all these candidates were eligible to be admitted as per regulations framed by MCI and the policy decision taken by the Government.

As per the MCI report PIMS denied seats to 15 eligible students but admitted 18 ineligible students and SVMC denied seats to five eligible students but admitted five ineligible students.
