Justice M V Muralidharan before whom the revision plea came on Friday ordered notice returnable by January 25.

The petitioner had contended that a private complaint was filed before the M.M George Town court against Rajinikanth’s remarks in the high court that he had included Rajinkanth’s name in a plea moved against Kasthuriraja, father of the actor’s son-in-law just to extort money from him.

But the magistrate dismissed the complaint for non-appearance of the complainant or his power attorney despite the plea seeking to transfer the case as the Magistrate was not inclined to hear the case as he was a fan and well-wisher of Rajinkanth.

The case has its source in a plea moved by Bothra that Kasthuriraja, had borrowed Rs 65 lakh from him with an assurance that even if he failed to repay the amount, Rajinikanth would pay it.

But, the cheques were dishonoured. The financier asked the high court to direct Rajinikanth to act against Kasthuriraja to prevent him from misusing his name.

But Rajinikanth in the counter filed at the High Court said such suits should be nipped in the bud.

Following this, Bothra moved a private complaint saying “I don’t intend to grab money from anyone.

I want him to retract his statement that I am trying to extort money from him. It has hurt me a lot.”
