The petitioner, Kathiresan, AITUC Town District Secretary from Madurai, had stated that he had recently read in the newspapers that the state government, on June 30, had given extension of two years to DGP TK Rajendran despite several allegations of corruption against him.

According to the records of the Income Tax (I-T) department, Rajendran had allegedly taken bribes from gutka companies to permit them to sell their products throughout the state. As charges of corruption have been framed against him, he should not be allowed to continue as DGP, stated the petitioner.

In a previous hearing, the Chief Secretary, Directorate of Vigilance and Anti Corruption (DVAC) and I-T were directed to file all the related documents concerned to the appointment of TK Rajendran and his involvement in the gutka case. As directed by the Court, the Chief Secretary and DVAC had submitted all the documents in sealed covers.

However, the IT department alone sought time of two weeks to submit the documents. High Court Judges, Sasidharan and Swaminathan, questioned that when I-T department was the first to frame charges against TK Rajendran to the Chief Secretary, then why the delay in submitting documents? The judges directed the IT department to submit the documents by July 12, and adjourned the case.

After the hearing, the counsel of the petitioner claimed that he and his petitioner had received threat calls for pursuing the case. Judges had then directed the counsel to submit his complaints in writing.
