Delivery death: Rs 10L relief to victim’s family

State Human Rights Commission has directed TN government to pay compensation of Rs 10 lakh to kin of deceased who died along with her infant during delivery in Government Hospital, Erode in 2018.

Based on a report in Daily Thanthi on December 3, 2018, about the woman’s death, SHRC had suo motu called for a detailed report from Director of Public Health and Preventive Medicine, Chennai.


Eventually, B Raj of Perundurai, Erode, filed a petition claiming that his wife Kanchana (23), was admitted to Primary Health Centre (PHC) in Vijayamangalam on November 29, 2018, after she developed pain. But she died on the same day owing to medical negligence, he alleged. He had submitted that on admitting his wife, Dr Vijayalakhsmi, Assistant Surgeon had checked Kanchana and said that she is ready for her delivery. Eventually, he learnt that nurse Suganya would be performing delivery as doctor had left to Chennai. Reports alleged that Suganya started delivery procedures when infant’s head came out partially, but she couldn’t complete the delivery. Immediately, Kanchana was taken to Thingalur PHC where she was refused treatment. Then she was rushed to GH in Erode, where doctors performed delivery and informed Raj that his wife and infant have died. Recording submissions, SHRC Chairperson D Jayachandran said, “It is duty of Vijayalakshmi to care and protect human life, but she failed to do so and violated human rights of Kanchana.” Awarding compensation of Rs 10 lakh to kin of deceased, commission recommended State to recover Rs 5 lakh from doctor and initiate actions against her. SHRC also asked the State to strictly monitor presence of doctors to attend delivery care in all PHCs and display the duty chart of the doctors and nurses in Tamil with mobile numbers.
