CHENNAI: The Madras High Court has rejected a petition filed for declaring the certificate of legal heirship of demised entrepreneur MAM Ramaswamy to MAMR Muthiah.

Justice N Sathish Kumar passed the orders on dismissing a petition filed by Dr MAM Ramaswamy Chettiar of Chettinad Charitable Trust represented by its managing trustee AC Muthiah.

The petitioner sought a direction to quash the order of Mylapore Tahsildar issuing a legal heirship certificate to MAMR Muthiah aka Iyappan who was the adopted son of MAM Ramaswamy.

“The impugned order of Mylapore Tahsildar herein granting Legal Heirship Certificate to MAMR Muthiah respondent as the legal heir of Dr MAM Ramaswamy is erroneous, incorrect, and unsustainable in law and the same deserves to be set aside,” the petitioner submitted. He further alleged that the respondent/adopted son was not in accordance with the custom of the Nagarathar community. The petitioner also alleged that the man possessing the legal heirship was not true to MAM Ramaswamy during his lifetime.

However, Mylapore Tahsildar submitted that the respondent had submitted proper document evidence. Recording the submissions, the judge dismissed the petition.
