“He does not believe what he said was against any law of the country and on the other hand, the existence of the statue with those words is certainly an offense punishable. The police department instead of taking action against the person who has erected the statue in front of the temple has unfortunately and unwittingly registered a case against this petitioner, ” Kannan’s advocate said in the affidavit.

Kannan further submitted that there were several videos circulated demeaning the Hindu Gods and their faiths, adding, “But, the same police has not taken any action on any of such persons, in spite of several and repeated complaints from various individuals and organizations.”

He further said that the arrest made by the police was against the Supreme Court’s order in KT Rajendra Balaji Vs State, through the Inspector of Police. According to him, while he filed an anticipatory petition before the HC and the same was numbered, the police knowing the same should not have arrested him.

Recently, while addressing a meeting of the Hindu Munnani organization in Maduravoyal, Kanal Kannan dared that a Periyar statue situated before the Sri Rangam temple should be demolished. Therefore, police arrested Kannan on the complaint of one Thanthai Periyar Dravidar Kazhagam functionary.
