Family dispute: Mom allowed to video-call girl

Following a representation made by a mother in a family dispute that it has been long since she interacted with her seven-year old daughter who is in her husband's custody, the Madras High Court arranged for a video chat between them.

Considering a request from the woman’s counsel Niveditha Ganesan that the mother has not been allowed to meet the child for long and would like to have a video chat/talk with the child, a division bench comprising Justice Vineet Kothari and Justice Krishnan Ramasamy said the court found the request to be genuine.

The bench then directed that the parties be present at the chambers of their counsels during pre-court hours on July 14 and take part in the video conference, and that the child may be allowed to have a video chat with the mother.

“Since the court is of the opinion that the welfare of the child is supreme in such cases, appropriate orders on the merits of the case may be passed after allowing the child to have a video chat with the mother and also on hearing the further arguments of the respective counsel in the present case,” the bench added.

As per the case, the earlier mediation between the parties had failed and two cases – one for divorce and another for restitution of conjugal rights – are pending on the file in the family court in Chennai. The child is in the custody of the father for the last three to four years in Chennai while the mother lives with her parents in Madurai.
