A division bench comprising Justice M Sathyanarayanan and Justice R Hemalatha before whom a Public Interest Litigation (PIL) moved by B Santhanam came up seeking to protect the temple said, “Though the petitioner has prayed for a larger relief, this Court, without going into the merits of the claim projected by the petitioner, either in his representation or in this writ petition, directs the respondents to look into the petitioner’s representation and give a disposal in accordance with law.”

The petitioner, a resident of Kasapuram had contended that he is an ardent devotee of Vanabhatra Kaliamman Temple at Agramthen Village in a land classified as Government Poramboke. But on February 9, 2019, the temple was desegregated by unknown miscreants and the complaint given in this regard, also failed to invoke any kind of response.

He further noted that his endeavour was to restore the temple to the original place and despite very many oral representations and a written representation on September 4, 2019, no action has come forth.

His counsel submitted that a FIR was also registered by Selaiyur Police Station for the alleged commission of the offences under Sections 153 and 295 of IPC (wanton vilification of religion). But no progress is being shown in the investigation and the desegregation of temple and displacement of the deity has affected the religious sentiments of the people of the locality.
