When the public interest litigation moved by one Vignesh came up before it, a division bench comprisingJustice M Sathyanarayanan and Justice N Seshasayee directed theExecutive Engineer of Zone 10 (Kodambakkam), to cause inspectionof the place.
Depending upon the result of the inspection, the official should take immediate and appropriate action adhering to the principles of natural justice, the bench added, directing the official to complete the exercise within six weeks.
In his petition, Vignesh alleged that a piece of land belonging the Greater Chennai Corporation was encroached by a person named, Veerappan. On that land, he constructed a permanent structure and started a general store to sell various articles, the petitioner added. According to Vignesh’s counsel, Veerappan is a politician and a member of the ruling AIADMK. That is why there was no action forthcoming from the Corporation Commissioner, despite several personal representations being filed.
While disposing the plea, the bench directed the Executive Engineer of Kodambakkam Zone to file a status report with supporting documents and photographs by December 6.
