    TNRERA directs IRWO to compensate retired staffer

    The Tamil Nadu Real Estate Regulatory Authority (TNRERA) has ordered Indian Railway Welfare Organisation (IRWO) to pay compensation to a retired railway employee for failing to execute sale deed of undivided share (UDS) of land.

    According to the judgment issued by the adjudicating officer G Saravanan, the respondent R Nagarajan, who is partially disabled, is entitled to receive Rs 2 lakh that he had paid the IRWO as advance, along with 12.5 per cent interest. Saravanan also directed to pay Rs 10,000 for mental agony and Rs 5,000 towards litigation charges.


    Nagarajan paid Rs 2 lakh as an advance to buy a flat in the housing scheme being implemented by the organisation at Ambattur. The organisation had sent only construction agreement and failed to execute sale deed for the undivided share of land.


    IRWO contended that the authority should dismiss the petition as it had no jurisdiction to try it. “The case is well covered under the RERA Act, which makes clear that any person makingadvance or deposit on the basis of information contained in the advertisement, which turns out to be false or incorrect and sustain any loss or damage, the promoter has to compensate him in the manner provided under the Act,” Saravanan observed.
