Student’s petition seeking re-evaluation of 7 papers dismissed

Justice S Vaidyanathan, on pointing out that the said regulations of Anna University are clear that the candidate can apply for re-evaluation of answer scripts for not exceeding five subjects at a time, said, “This Court is of the view that the answer scripts of the petitioner for two papers, cannot be directed to be revalued as it runs counter to the said decision of the Supreme Court and the said regulations. The court cannot sit in appeal over the administrative decisions of the University and give a decision.”

“If this kind of contention is accepted, then tomorrow a student who has failed in 31 papers will plead that all the 31 papers have got to be re-evaluated,” he said.

If the contention of the petitioner is accepted, then it would amount to giving a premium to the failed students and opening the pandora’s box, he added.

The petitioner S Swetha Priyadarshini had contended that out of the 31 papers she wrote, she had cleared 24 papers and failed to clear seven papers.

She stated that when she requested for re-evaluation of papers,  the university authorities agreed to re-evaluate five papers and failed to consider the two other papers.

Claiming that it was the last attempt of the prescribed seven years to complete the course, she sought the court to permit re-evaluation of the remaining two papers.

However, Anna University in its counter had contended that the regulation that a candidate can apply for re-evaluation of answer script not exceeding five subjects at a time has been finalised after detailed deliberations and consideration of various issues. It has been decided that the regulation cannot be relaxed and if relaxation is offered, it would have a greater impact, the university added.
