    Railways announces 8 lakh compensation to EMU mishap victims

    Three days after the tragic mishap that killed five train commuters after being smashed against a concrete fence on the platform at St Thomas Mount railway station while travelling on footboard in an overcrowded EMU during morning rush hour, the Railway Claim Tribunal, Chennai, suo motu announced Rs 8 lakh compensation for each of the deceased and Rs 2 lakh for the injured.

    This is the first of its kind of compensation order by the Tribunal even without receiving any formal application from the victims’ families. A press release from the Tribunal said that it has been decided that Rs 8 lakh would be deposited for each of the four cases of death and Rs 2 lakh would be deposited for each of the five people injured.  

    However, the Tribunal has ordered the immediate release of Rs 2 lakh to each of the cases of death and Rs 50,000 each in case of injuries. The amount deposited will be adjusted against the final outcome of awards, the press release from J Arundathi, additional registrar, said.  

    It looks like the Tribunal decision was taken before the official announcement of the death of the fifth victim in the hospital on Thursday night.  

    The Tribunal also observed that in the law of strict liability there is hardly scope for denying liability with the status of the victims as passengers and incident as untoward by a fall from the train are clearly established.  

    The bench also has directed that the applications can be filled in with details of the dependents of the deceased and that the Tribunal would adopt a flexible approach in allowing for amendments in the applications if details are disclosed later. 

    Notices have been issued to government, Railway Police, Railway Protection Force and GM, Southern Railway and police have been asked to furnish copies of all the police records regarding the gruesome incident, the press release stated. 

    The families of victims are advised to approach the tribunal functioning at Fresh Ford, 50, Mc Nicholas Road, Chetpet for any further information.
