Chennai
Justice Sundar delivered a verdict against the state government in the split verdict in the 18 AIADMK MLAs’ disqualification case and the threat is alleged to have a direct connection with his judgement.
According to sources, Justice Sundar has not taken the letter seriously and preferred not to give a written complaint. However, it was a cause of concern for the CJ Banerjee, who is reportedly have sought additional security for the judge’s family. Justice Sundar on June 14 had set aside the disqualification while CJ, the other judge in the bench and delivered the judgement in favour of disqualification. Though he is currently on deputation in Madurai bench of the Madras HC, his family lives in Chennai.
Justice Sundar had held that the TN assembly Speaker’s order on disqualifying the 18 MLAs from TTV Dhinakaran camp can be struck down on the grounds of non-compliance with the principles of natural justice. The Chief Justice on the other hand had ruled the disqualification under the anti-defection law was in no way unreasonable. In view of the divergent views taken by the two judges forming part of a Division Bench, the matter was referred to a third judge M Sathyanarayanan.
Meanwhile, DMK working president MK Stalin on Sunday said the reported threat received by High Court judge M Sundar was also aimed at the third judge M Sathyanarayanan, appointed to hear the 18 MLAs disqualification case.
