Disposing a plea moved in this regard, the first bench of Chief Justice Indira Banerjee and Justice Abdul Quddhose said, “The permission for the installation of the plant was obtained from the Pollution Control Board.

Even then, the authorities shall see to it that no foul smell or the smell of pesticides emanates. The authorities concerned shall also take preventive measures to avoid health hazards to people leaving in and around the area. If needed, fumigation has to be done.”

The state government, to safeguard the groundwater table in and around Sathyamangalam village of Erode district and to protect the water resource in Bhavani Sagar, had proposed to construct a sewage treatment plant and allocated Rs 54.26 crore.

However, petitioner Lakshmanan had moved the court seeking to shift the plant as it is to be set up in a densely populated area and hence would cause damage to the environment and affect people.
