    Leaky Maple pays 200 crore, to sail away

    Even as there is controversy regarding the no-objection certificate (NOC) issued by the Nautical Surveyor cum Deputy Director General of Shipping, Mumbai for the sail of the vessel, BW Maple, one of the two ships that collided off the Ennore coast on January 28, causing a devastating oil leak, the Madras HC has refused to interfere with the NOC, which allows the ship to sail out of Indian waters.

    The first bench comprising Chief Justice Indira Banerjee and Justice M Sundar on disposing a plea moved by the National Union of Fishermen seeking to set aside the NOC, said, “There is not even a whisper in the petition as to how the further detention of the vessel would be of any use. 

    The bank guarantee that was furnished by the ship owner for Rs 203 crore covers the claims of the petitioner. The Kancheepuram Dawn vessel owners have also furnished a draft bank guarantee of equal amount which is awaiting approval.” 

    Also noting that both the vessels are covered by insurance and the question of compensation is seized by the National Green Tribunal in Chennai, the bench held, “We do not want to interfere in either the issue of compensation or the NOC issued by the Director General of Shipping.” 

    However, the bench directed the Director General of Shipping and the police to complete the investigation, including the internal investigation of fixing responsibility for the crash and the resultant oil spill.
