Granting an interim stay on the operation of the single judge’s order, a division bench comprising Justice Huluvadi G Ramesh and Justice G Jayachandran on Wednesday also ordered notice both to the Union home ministry and the state government. Senior counsel Vijay Narayan, appearing for Jangid, submitted that the petitioner V Vidya, who has approached the court challenging Jangid’s promotion, is an accused in a CBI registered case.

Moreover, she has no locus standi to challenge the elevation granted to the officer, he said. Pointing out that the cases registered against Vidya were done by the jurisdictional inspector of police and Jangid had no role in it, he said the issue in question is a service matter and the Central Administrative Tribunal (CAT) alone has jurisdiction.

The single judge, on Monday, had ordered status quo on the plea moved by Vidya alleging that due to personal animosity, several criminal cases had been foisted against her following instructions from Jangid.

She had contended that while many of the cases foisted against her were either stayed or quashed, there are many land grab allegations pending against the officer. She had also claimed that the elevation was not done in accordance with law and that Jangid was unfit for promotion.
