    Journo’s son moves court over property

    The travails of journalist Jennifer Arul, who waged a lengthy court battle against her husband Michael Arul, under domestic violence act before being awarded compensation does not seem to have ended. Now, her son David Arul is locked in a court battle with his father Michael over the sale of their ancestral property measuring eight grounds and 2177 square feet on Pantheon Road in Egmore.

    The property in question was inherited by Michael’s mother Mabel Arul from her mother Sugirtham Thomas. Mabel, in turn, had settled the property in favour of her grandson David Arul, while giving her son Michael a limited life interest with no power of alienation.

    But contrary to law that a gift can’t be cancelled, the settlement deal, which was in existence was revoked in Michael’s favour. Exploiting the same, Michael had changed the property tax to his name and thereafter sold the same in a hurried manner for Rs.23 crore while the property is worth much more. 

    Moreover, with a court order existing against selling this property, the sale has been executed by suppressing the fact it is a property under litigation. 

    Legal experts, pointing out that this is a classic example of how properties under litigation are sold, say that the sale document being created in just three days is an eye opener as to how registration officials act, when they have decided to favour someone. 

    In this particular case, the application has been made on July 5, and the so-called inspection done on July 6 and the document registered after office hours and handed over on July 7. 

    Coming as a shocker about his ancestral property, which rightfully belongs to him and that a settlement deal cannot be revoked as per law, David immediately moved the Madras High Court for relief. After a bout of initial hearing, the case has been posted to July 25 for further hearing.
