Man accused of impregnating niece denied bail
The Madras High Court, on refusing to grant anticipatory bail to a person, who allegedly impregnated his niece on the promise of marrying her, condemned him as being ‘worse than an animal and that he is a sin to the society.’

Justice S Vaidyanathan, on taking strong exception over the behavior of the accused in dilly dallying the case by agreeing to marry her, said, “It is really shocking when the petitioner’s counsel submitted that the accused wants to conduct a DNA test and until such time, he could be granted interim anticipatory bail. This attitude of the petitioner towards his own sister’s daughter is highly condemnable, which makes this court to state that he is worse than an animal and this inhuman approach of the petitioner makes this court to further observe that he is a sin to the society.”
As per the case, the petitioner and his niece, who is the de-facto complainant fell in love with each other. Based on the promise made to marry her, he had physical relationship, out of which, she has now given birth to a child. The girl had also submitted that her uncle now claims that he had physical relationship with her for entertainment and not with any intention to marry her.
Now, apprehending arrest at the hands of Avadi police for the alleged offences punishable under Sections 493 and 506, which deal with deceitfully inducing a belief of lawful marriage and criminal intimidation, the petitioner has sought anticipatory bail.
The judge, while observing that this court wanted to dismiss the anticipatory bail petition even at the initial stage, but had agreed to meditation with reluctance, said, “The accused has not only defrauded the victim, but also played fraud upon the court by making the counsel to represent that the matter would be settled and he would marry the victim. The act of the accused cannot be taken lightly.”
Also, noting that this is a fit case where the petitioner should be taken to custody, Justice Vaidyanthan, said, “It is very unfortunate that the accused like the present petitioner are cheating women with sexual aim, without realising the fact that they have a life of their own and they are also human beings made of flesh and blood.”
