    Arumbakkam temple gets back land

    It is freedom for the deity of Arulmighu Bala Vinayakar Temple which was kept locked at the Arumbakkam police station over a dispute. The Madras High Court while restraining a person from encroaching upon the temple land has allowed the Arumbakkam Bala Vinayagar Nagar Welfare Association to get back the idol and perform rituals and poojas.

    Justice S Vaidyanathan while upholding the order of the trial court and first appellate court, said “When the plaintiff-association has established it’s right not only through documentary evidence, but also through verbal evidence, which has been accepted by the lower courts and that there was the idol at the intersection of the roads, the lower courts were right in decreeing the suit in favour of the plaintiff.” 

    “It is open for the plaintiff association to approach the concerned police station and get back the idol and perform the rituals, poojas, etc., in accordance with law without hindering the residents of the locality”, the judge added.

    Originally, Arumbakkam Bala Vinayagar Nagar Welfare Association filed a suit to restrain one Jayarman from encroaching upon the land belonging to Arulmighu Bala Vinayagar and Arulmighu Sree Saptha Kanniamman Temple in Arumbakkam. 

    The association contended that Jayaraman, who had purchased the adjoining property, was attempting to encroach upon the temple land. He had also damaged the temple structure in a bid to demolish it and take over the site for his own occupation. A complaint was lodged with Arumbakkam police on February 19, 2007 in this regard. Meanwhile, Jayaraman had argued that the temple was situated a few kms away and was under the HR and CE department, and not the association.
