Petition over fixing of thumb impression in nominations
The controversy over the ailing Tamil Nadu Chief Minister J Jayalalithaa signing election affidavits with a thumb impression gathered more steam after the Court has been moved to declare the attestation with her left thumb impression (LTI) as illegal and ultra vires of the Constitution as it violated the election code of conduct.
Chennai
Social activist Traffic K Ramaswamy, filing a PIL petition in this regard, has contended that placing thumb impression is allowed only in the cases wherein the candidature or signatory is bereft of basic education and is an illiterate, while in the case of sick and disabled persons Rule 37(4) under the conduct of Election rules 1961 applies squarely.Â
Pointing out that as per available reports the Chief Minister and AIADMK party chief, hospitalised for the past forty days, had signed-off the election with a thumb print since her right hand is inflamed, said the issue raises a lot of questions that need urgent attention.
