Major relief to octogenarian in land grab case
The High Court has come to the rescue of an 84-year-old man by directing the cops to take steps to restore his land worth Rs 8 crore that was grabbed.

Justice PN Prakash, who posted the matter for compliance to Friday, directed the DCP, T Nagar, to provide sufficient protection to the inspector at Virugambakkam to remove the encroachers from his land.
The property in question is a 4,000 sq ft at Kumaran Colony, Vadapalani. This was purchased by VVV Nachiappan, in the name of his wife Saraswathi in 1961. After the death of his wife in 2001, the property devolved to him and his children.
But in 2011, SN Padmanathan and others created forged documents and encroached upon the property. On coming to know about it, Nachiappan moved the authorities and got cancelled the fraudulent deed and sale agreements on October 10, 2012.
However, suppressing these facts Padmanathan created another sale deed on April 17, 2013, in favour of his accomplice PM Elavarasan. This was again cancelled by the registration authorities. Notwithstanding this, Elavarasan moved the high court seeking a direction to the sub-registrar to release his sale deed.
Justice S Vaidayanathan, who heard the plea, dismissed it with costs of Rs 1 lakh after observing that “unfortunately, there is no law in India to cut off the fingers of persons who indulge in this type of acts.” Subsequently, Elavarasan’s appeal was also dismissed by a Division Bench.
Despite this, Nachiappan, who went to inspect his land, was threatened by goondas engaged by Elavarasan, forcing him to move the court seeking police protection. Elavarasan approached the High Court yet again seeking a direction to restrain police from interfering with the peaceful possession of the property. He made Nachiappan as the third respondent in the petition. This resulted in Justice Prakash ordering the immediate removal of the encroachers.
