The first bench comprising Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan, on perusing the government report on the legality of camel slaughtering and the rules governing it, held that the justification of camel slaughter based on powers vested with the Corporation Commissioner in declaring any area as slaughter area is untenable.

The bench also noted that the camels are not available in Tamil Nadu and their import from Rajasthan and Gujarat is illegal per se as those states have banned transport of camels.

The bench also held that the state seemed to be relying more on transport rules to back the import of such animals while rules pertaining to prevention of cruelty to animals had been ignored.

Counsels appearing on behalf of petitioner against the slaughter also stressed on the aspect that prevention of cruelty to animals (slaughter house) 2001 Act has clearly laid out that animals which can be slaughtered for food have to be slaughtered only in licensed slaughter houses.
