    PIL to stay TNCA poll dismissed

    The Madras High Court has dismissed a PIL which sought to restrain the Tamil Nadu Cricket Association (TNCA) from holding elections because Justice R M Lodha Committee’s recommendations for restructuring state cricket associations had not been fulfilled in the state.

    The first bench comprising Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan said: “The issues arising from the recommendations of Justice Lodha Committee are before the Supreme Court. The matter is still being examined. The endeavour of the petitioner seems to be to disturb the present administration through a process of a writ under Article 226 of the Constitution of India rather than under the bye-laws of the society. 

    We cannot permit the same. As to what will be the fate of the overall structure of the cricketing association, it appears would be determined by the Supreme Court.” When the matter was taken up, the petitioner S Srinivason’s counsel M Velmurugan submitted that the June 25 election should be stayed and directions should be issued appointing an administrator to administer TNCA to enable necessary amendments to be made in the memorandum of association and hold elections in a democratic manner. 

    In his petition, Srinivason said that in its report dated December 18, 2015, Justice Lodha Committee had observed that it was not satisfied with the present functioning of various bodies associated with cricket. It said elected bodies of associations at the state and national levels were operating without a structured approach, and that most of the positions had been taken over by influential persons. “Several persons occupy key positions for great length of time, and they manipulate rules and election processes in such a manner that they will continue to remain in power,” it said.
