    CMDA slammed for delaying permission

    The High Court has slammed the Chennai Metropolitan Development Authority (CMDA) for not offering planning permission for building constructions citing the polls despite it having no relation to it.

    The First Bench Comprising Chief Justice Sanjay Kishan Kaul and Justice MM Sundresh, on ascertaining from the Counsel for State Chief Electoral Officer and Chief Election Commissioner of India that as long the issue does not concern any policy issue, the normal processing has to be done and the Election Commission is no way concerned with it, directed the CMDA to speed up the process of offering planning permission for building construction.

    The matter relates to a Public Interest Litigation moved by the Confederation of Real Estate Developer’s Association of India (CREDAI) that the process of planning permissions for building construction has come to a standstill on the specious plea of impending elections. 

    Also, on recording the submission made by the counsel appearing on behalf of the CMDA that the applications will not be kept in abeyance and processed as per the provisions of Tamil Nadu and Country planning Act, 1971, the first bench also held that “Expeditious processing also would be required because these applications have been unnecessarily kept pending. The CMDA to ensure due compliance and we are sure that no cause would be given for initiation of contempt proceedings.”
