Corporation Commissioner summoned in plan violation case
The Madras High Court has summoned the Chennai Corporation Commissioner for non-compliance of an order passed by the Secretary, Housing and Urban Development Department.

A division bench. comprising Justices Satish K Agnihotri and P Devadass, which passed orders on a petition filed by one LG Ravi of Mogappair, directed the Corporation Commissioner to be present on February 4 with the action taken report.Â
The matter relates to serious deviations in the buildings constructed in Plot No’s 67 and 71 in Mogappair, which is adjacent to the building owned by Ravi, the petitioner. On an appeal filed by the deviators, the Housing and Urban Development Department, which is the appellate authority, passed an order on April 25, 2015 directing them to apply for a fresh planning permission to Chennai Corporation. It also directed the deviators to raze the unauthorised constructions within six months.
Being an adjacent resident, the petitioner again filed an RTI and got a reply that the order passed by the appellate authority was not implemented by the deviators and filed the present petition.Â
He submitted that the deviators ought to have complied with the order before October 24, 2015. Further, the deviators have not even obtained nod for the revised plan and the authorities should not have allowed the deviators to flout the orders passed by the appellate authority.
